NOTE TO FOURTH AND FIFTH DISTRIBUTIONS

Recently, the Trustee authorized two distributions of approximately 12% on allowed claims of beneficiaries of the Liquidating Trust. Because of the tentative settlement (subject to District Court approval) of a class action lawsuit filed against certain banks through which Slatkin conducted his banking activities, the Trustee has, in some cases, reserved for but not paid certain of the distributions. The litigation and the reason why the Trustee has reserved certain distributions is explained in the letter which is attached. Further information concerning the class action litigation and the Trustee’s decision to reserve the payment of distributions may be obtained by contacting counsel identified in that letter.

PROOF OF CLAIM FORM

A Proof of Claim form is a form telling the bankruptcy court how much the debtor owed a creditor at the time the bankruptcy case was filed (the amount of the creditor's claim). This form must be filed with the clerk of the bankrutpcy court where the bankruptcy case was filed.

The Attached Bar Date Notice indicates when Proofs of Claim are required to be filed with the Bankruptcy Court. Also attached is a Proof of Claim form and a supplement to Proof of Claim designed specifically for the Slatkin bankruptcy case.
